1. Acceptance of Terms

By accessing or using the Hivemind mobile application and related services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms. We will provide notice of material changes through the app or via email.

2. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that:

You are at least 18 years of age
You have the legal capacity to enter into these Terms
You are not prohibited from using the Service under applicable law
Your use of the Service will not violate any applicable law or regulation

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any reason at our sole discretion.

4. Identity Verification

To unlock posting capabilities, users must complete identity verification through our third-party verification service. By completing verification, you:

Consent to the collection and processing of your identity documents by our verification partner
Represent that all information provided is accurate and authentic
Understand that verification is required to help maintain community safety
Acknowledge that providing false or fraudulent identification is prohibited and may result in permanent ban

Unverified users may browse content but cannot create posts or comments.

5. User Content

5.1 Your Content

You retain ownership of content you post on the Service ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display your User Content in connection with operating and providing the Service.

5.2 Content Responsibility

You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:

You own or have the necessary rights to post your User Content
Your User Content does not violate the rights of any third party
Your User Content complies with these Terms and all applicable laws

5.3 Content Archival

Posts that fall outside the active feed (top 100 posts by recent activity) become archived and immutable. Archived content cannot be edited, deleted, or commented on by users. This is by design to preserve the integrity of community discussions.

6. Prohibited Content and Conduct

You agree not to post, upload, or transmit any content that:

Is illegal, harmful, threatening, abusive, harassing, defamatory, or libelous
Contains child sexual abuse material (CSAM) or exploits minors in any way
Promotes violence, terrorism, or hatred against individuals or groups
Contains sexually explicit or pornographic material
Infringes any patent, trademark, copyright, or other intellectual property rights
Contains malware, viruses, or other harmful code
Constitutes spam, phishing, or fraudulent activity
Impersonates any person or entity
Violates the privacy of others by sharing personal information without consent
Promotes illegal drugs, weapons, or other illegal activities
Contains doxxing, threats, or incitement to harm

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of repeat offenders.

7. Content Moderation

We employ various methods to moderate content, including:

Automated Moderation: Automated systems may filter or flag content that appears to violate our policies
User Reports: Users can report content that violates our Terms
Human Review: Our moderation team reviews flagged content and reports
Image Moderation: Images are scanned for prohibited content before posting

We are not obligated to monitor all content but reserve the right to do so. Content that receives multiple reports may be automatically hidden pending review.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Hivemind and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

10. Location Services

The Service requires access to your device's location to function. By using the Service, you consent to:

Collection of your location data to show nearby posts
Use of your location to determine post visibility radius

Your precise location is never shared with other users. Only approximate distance may be displayed.

11. Advertising

The Service may display advertisements, including promoted posts, banners, and other ad formats. By using the Service, you agree that:

We may display advertisements based on your general location
Advertisements may be targeted based on location and other non-personal factors
We are not responsible for the content of third-party advertisements

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Service will be uninterrupted, secure, or error-free
The results obtained from using the Service will be accurate or reliable
Any errors in the Service will be corrected
User Content posted by others is accurate, reliable, or lawful

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HIVEMIND, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Any User Content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount you paid us, if any, in the past twelve months.

14. Indemnification

You agree to defend, indemnify, and hold harmless Hivemind and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your User Content

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

Your right to use the Service will immediately cease
We may delete or retain your account information and User Content at our discretion
Provisions of these Terms that by their nature should survive termination shall survive

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.

You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and Hivemind regarding the Service and supersede all prior agreements and understandings.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of these Terms must be in writing and signed by Hivemind.

21. Apple App Store Additional Terms

If you downloaded our app from the Apple App Store, you acknowledge and agree that:

These Terms are between you and hivemind only, not with Apple
Apple has no obligation to furnish any maintenance and support services
Apple is not responsible for any product warranties or claims
Apple is not responsible for addressing any claims related to the app
Apple and its subsidiaries are third-party beneficiaries of these Terms

If you downloaded our app from Google Play, you also agree to the Google Play Terms of Service.
